Airbnb Occupancy Tax: A Host's Concerns

Here's a concise summary of the situation. Airbnb automatically collects a thirteen to fourteen percent occupancy tax directly from guests in Las Vegas as a line item. Hosts cannot opt out of this charge. Clark County has no collection agreement with any accommodation facilitator and won't accept taxes from unlicensed short-term rentals. Hosts are legally responsible for remitting these taxes, and Airbnb hasn't even applied for facilitator status. The tax is applied to reservations and hosts non uniformily. Despite occupancy tax only applying to under 30 day bookings airbnb has broadly applied it to most bookings regardless of license status or length of booking. Additionally a situation arose with a booking of 60 days where the fee was being applied and through personal and projessional connections my client was able to have the tax removed from his listing and bookings. I estimate in clark county alone airbnb has collected two hundred fifty million dollars in the past five years , based on sixty-five million collected in the past year. Airbnb's global fund is only one hundred million dollars often called occupancy tax but lately just called tax. They don't disclose to guests that the tax won't be remitted. Clark County's December 2025 notice below provides foreshadowing of what might be coming.

To top it off, sometimes the 'tax' rate charged is even higher than the actual tax rate!! Here is one example as i was checking i had to review the exact Clark County rate and what's included in the tax base. The Clark County combined transient lodging tax rate is ten point five to thirteen point three eight percent, depending on the property's location. Airbnb's help page states this tax applies to the listing price, including cleaning and guest fees. For the booking in question, the four hundred nine dollars and ten cents in taxes is fifteen point three nine percent of the two thousand six hundred fifty-seven dollars and sixty-three cents nightly rate plus cleaning fee. This is higher than the official rate
